1. Identifying details

2. Users

Access to and/or use of this BEER SPA portal confers the status of USER, who accepts, from the moment of such access and/or use, the General Terms of Use set out herein. The said Terms shall apply irrespective of the General Terms of Contract that may, where appropriate, be mandatory.

3. Use of the portal

www.beerspain.com provides access to a great deal of information, services, programs or data (hereinafter, "the contents") on the Internet belonging to BEER SPA or to its licensors to which the USER may have access. The USER assumes responsibility for the use of the portal. That responsibility extends to any registration that may be necessary in order to access certain services or contents. In such registration the USER shall be responsible for providing truthful and lawful information. As a result of this registration, the USER may be provided with a password for which they will be responsible, undertaking to make diligent and confidential use of it. The USER undertakes to make appropriate use of the contents and services (such as, for example, chat services, discussion forums or newsgroups) that BEER SPA offers through its portal and, by way of example but not limitation, not to use them to (i) engage in unlawful, illegal activities or activities contrary to good faith and public order; (ii) disseminate content or propaganda of a racist, xenophobic or illegally pornographic nature, glorifying terrorism or infringing human rights; (iii) cause damage to the physical and logical systems of BEER SPA, its suppliers or third parties, introduce or spread computer viruses on the network or any other physical or logical systems liable to cause the aforementioned damage; (iv) attempt to access and, where appropriate, use the email accounts of other users and modify or manipulate their messages. BEER SPA reserves the right to remove all those comments and contributions that infringe respect for the dignity of the person, that are discriminatory, xenophobic, racist or pornographic, that harm young people or children, public order or public safety or that, in its judgement, are not suitable for publication. In any case, BEER SPA shall not be responsible for the opinions expressed by users through the forums, chats or other participation tools.

4. Data protection

BEER SPA complies with the guidelines of Ley Orgánica 15/1999 of 13 December on the Protection of Personal Data, Real Decreto 1720/2007 of 21 December approving the Regulation implementing the Organic Law, and other legislation in force at any given time, and endeavours to guarantee the correct use and processing of the user's personal data. To this end, alongside each form for collecting personal data, BEER SPA will inform the user of the existence and acceptance of the particular conditions for the processing of their data in each case, informing them of the responsibility for the file created, the address of the data controller, the possibility of exercising their rights of access, rectification, cancellation or objection, the purpose of the processing and any communications of data to third parties. Likewise, BEER SPA states that it complies with Ley 34/2002 of 11 July, on Information Society Services and Electronic Commerce, and will request your consent to the processing of your email for commercial purposes at any given time.

5. Intellectual and industrial property

BEER SPA, on its own behalf or as assignee, is the owner of all the intellectual and industrial property rights of its website, as well as of the elements contained therein (by way of example, images, sound, audio, video, software or texts; trademarks or logos, colour combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), owned by BEER SPA or by its licensors. All rights reserved. By virtue of the provisions of articles 8 and 32.1, second paragraph, of the Intellectual Property Act, the reproduction, distribution and public communication, including the modality of making available, of all or part of the contents of this website, for commercial purposes, on any medium and by any technical means, without the authorisation of BEER SPA, are expressly prohibited. The USER undertakes to respect the Intellectual and Industrial Property rights owned by BEER SPA. The USER may view the elements of the portal and even print, copy and store them on the hard drive of their computer or on any other physical medium provided that it is solely and exclusively for their personal and private use. The USER shall refrain from deleting, altering, circumventing or manipulating any protection device or security system that may be installed on the pages of BEER SPA.

6. Exclusion of warranties and liability

BEER SPA shall not be liable, in any case, for damages of any nature that may be caused by, by way of example: errors or omissions in the contents, unavailability of the portal or the transmission of viruses or malicious or harmful programs in the contents, despite having adopted all the technological measures necessary to prevent it.

7. Modifications

BEER SPA reserves the right to make, without prior notice, any modifications it deems appropriate to its portal, being able to change, delete or add both the contents and services provided through it and the way in which these appear presented or located on its portal.

8. Links

In the event that the domain name provides links or hyperlinks to other Internet sites, BEER SPA shall not exercise any type of control over such sites and contents. In no case shall BEER SPA assume any responsibility for the contents of any link belonging to a third-party website, nor shall it guarantee the technical availability, quality, reliability, accuracy, comprehensiveness, veracity, validity and constitutionality of any material or information contained in any of such hyperlinks or other Internet sites. Likewise, the inclusion of these external connections does not imply any type of association, merger or participation with the connected entities.

9. Right of exclusion

BEER SPA reserves the right to deny or withdraw access to the portal and/or the services offered, without prior notice, on its own initiative or at the request of a third party, to those users who fail to comply with these General Terms of Use.

10. General provisions

BEER SPA will pursue any breach of these terms as well as any improper use of its portal, exercising all civil and criminal actions to which it may be entitled by law.

11. Modification of these terms and duration

BEER SPA may modify at any time the terms determined herein, which shall be duly published as they appear here. The validity of the aforementioned terms shall depend on their display and they shall remain in force until they are modified by others duly published.

12. Applicable law and jurisdiction

The relationship between BEER SPA and the USER shall be governed by the Spanish legislation in force and any dispute shall be submitted to the Courts and tribunals of the city of Granada.

13. Withdrawal and refunds

In accordance with Real Decreto Legislativo 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users, the USER has a period of 14 calendar days, counted from the date of purchase of the voucher, to withdraw from the purchase and request a refund of the amount paid, without the need for justification. Once that period of 14 calendar days from the sale of the voucher has elapsed, no refunds will be accepted nor will the amount be reimbursed, with the voucher retaining its validity for the redemption of the experience in accordance with the terms in force at the time of purchase. To exercise the right of withdrawal, the USER must notify BEER SPA by email at comercialges@pesan.es.

14. Warning

This merchant undertakes not to permit any transaction that is illegal, or is considered by the credit card brands or the acquiring bank to be capable of, or to have the potential to, damage their goodwill or negatively influence them. The following activities are prohibited under the card brand programs: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Buyer, Issuing Bank, Merchant, Cardholder, or cards. In addition, the following activities are also explicitly prohibited: Sale of alcoholic beverages to persons under 18 years of age.
